Details/Context:

Neil Gorsuch:

Yesterday, the Senate Judiciary Committee advanced Neil Gorsuch's nomination to the Supreme Court on a party-line vote of 11-9. Nevertheless, 43 Democrats (including California Senators Dianne Feinstein and Kamala Harris) have now committed to supporting a filibuster against his nomination.

Senate Majority Leader Mitch McConnell is expected to file a motion of cloture some time today, which would set up a cloture vote on Thursday and a final confirmation vote by the full Senate on Friday. At this point, a three-fifths majority (60 votes) would be required to pass a cloture motion, but McConnell has stated his intention to use the so-called "nuclear option" and change the Senate rules to allow a cloture motion on a Supreme Court nominee to be passed by a simple majority.

CA Legislation:

Yesterday, the California Senate voted to approve three bills aimed at mitigating some of the Trump Administration's anti-immigrant and anti-Muslim policies. SB-54—the "sanctuary state" bill—bars state and local law enforcement from using their resources to help federal immigration enforcement. SB-31, the California Religious Freedom Act, would prohibit state and local agencies and law enforcement from creating or participating in any religious-based registries. SB-6 provides access to legal representation by individuals facing deportation.

All three bills will now head to the California Assembly. Under California law, once a bill has been introduced into a chamber of the legislature (either its initial introduction or because it has passed the other chamber), 30 calendar days must pass, allowing time for public review, before any action may be taken. The first actions in the Assembly, including committee hearings, can therefore likely be expected in early May.

Scott Gottlieb:

The confirmation hearing for Scott Gottlieb, Trump's pick to head the Food and Drug Administration, are set to begin tomorrow at 10:00 AM EDT in the Senate Health, Education, Labor and Pensions Committee. A physician and venture capitalist, Gottlieb's stated priority for the FDA is to remove existing protections in order to, as he claims, help bring new products to market.

Gottlieb currently serves on the board of several major pharmaceutical companies, including GlaxoSmithKline. He is also the acting chief executive of Cell Biotherapy, a biotech company involved in cancer research. According to the New York Times, he has received millions of dollars from the drug and healthcare industry, including more than $150,000 from Vertex Pharmaceuticals from 2013 to 2015. Given his existing relationships with the drug and biotech industry, it is unclear how effective Gottlieb would be as the head of that industry's chief watchdog agency.

Script for Calling Dianne Feinstein

"Hi, my name is _____ and I'm calling from _____ (zip code). I'm calling to thank Senator Feinstein for committing to oppose Neil Gorsuch's nomination to the Supreme Court, and supporting a Democratic filibuster. I strongly believe that Judge Gorsuch's record on women's rights, LGBTQ rights, worker's rights, immigration, and environment show him to be too dangerous for us to have on our highest court, so I'm glad I can count on Senator Feinstein to stand up for us. I'd also like to ask the Senator to please oppose the nomination of Scott Gottlieb as FDA Commissioner. Given his history of working for the pharmaceutical industry, I don't think Mr. Gottlieb can be trusted to head that industry's chief watchdog agency. Thank you."
